What does Jem say to Atticus about rape? Does he say he thinks it SHOULD be allowed?

Jem was shaking his head. “I know it’s not right, but I can’t figure out what’s wrong-maybe rape shouldn’t be a capital offense…”

Jem does NOT think rape should be allowed. He does, however, question its classification as a capital offense, or an offense punishable by death.
