Why did Elwell file a lawsuit against Ned Boyne in the novel, Afterward?

Robert Elwell worked alongside Ned in the business of the Blue Star Mine. However, Ned's success came at the expense of Elwell's livelihood, and he was soon thrust into poverty. This loss led to a lawsuit filed against Ned Boyne, but the case was thrown out.
